Terms & Conditions

Last updated: [Month Day, Year]

These Terms and Conditions (“Terms”) apply to your use of simplegravel.com and to all orders for materials and delivery from [Company Legal Name] (“Simple Gravel,” “we,” “us,” or “our”). By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website or our services.

1. Our Services

Simple Gravel supplies and delivers bulk landscaping and construction materials, including gravel, crushed stone, sand, soil, fill, and mulch, within the contiguous United States. We work with local suppliers and delivery partners in each service area. Product availability, material sources, and delivery options vary by location.

2. Orders and Quotes

  • An order is accepted only when we confirm it. We may decline or cancel any order, for example if the delivery address is outside our service area, the site cannot be safely reached, or material is unavailable.
  • Quotes are based on the information you provide, including the delivery address, quantity, and site conditions. If that information turns out to be inaccurate, the price or delivery plan may change.
  • Our project calculator and any quantity suggestions are estimates only. You are responsible for confirming the amount of material your project needs.

3. Pricing and Payment

  • Prices are shown in U.S. dollars and may include separate delivery charges, depending on your location and order.
  • Payment is due as stated at checkout or on your order confirmation. Payments are processed by third-party payment providers.
  • Prices, delivery fees, and product availability may change without notice, but changes will not affect an order we have already confirmed unless you change that order.

4. Delivery

  • Scheduling: delivery dates and time windows are estimates. Weather, road conditions, supplier availability, and other factors outside our control may cause delays. We will contact you if your delivery needs to be rescheduled.
  • Access: you are responsible for providing a clear, safe route for a loaded delivery truck, including enough width, height clearance, and firm ground. Please tell us about gates, low wires, overhanging branches, soft ground, septic systems, or underground utilities before delivery.
  • Placement: the driver will place material as close to your requested spot as can be done safely. The driver may decline to enter a property or choose a different drop location if conditions are unsafe.
  • Property: loaded trucks are heavy. Driving onto driveways, lawns, curbs, or private roads at your request is at your own risk, and Simple Gravel is not responsible for cracking, rutting, or other damage to these surfaces, or to items not disclosed to us before delivery.
  • Someone on site: you or someone you authorize should be available by phone on delivery day. If no one is present, we will deliver to the location described in your order.
  • Permits: if a delivery requires placing material on a street or public right-of-way, you are responsible for any required permits.

5. Rescheduling and Cancellations

  • To reschedule or cancel, contact us at least 24 hours before your scheduled delivery.
  • Changes made with less than 24 hours’ notice, or after material has been loaded or dispatched, may not be possible and may result in charges for material, hauling, or a return trip.
  • If a delivery cannot be completed because of site access problems, incorrect information, or no access on arrival, additional charges may apply.

6. Materials

  • Gravel, stone, sand, soil, and mulch are natural products. Color, size, texture, and moisture can vary between loads, suppliers, and locations, and photos on our website are examples only.
  • Bulk materials are sold by weight or volume. Moisture content and settling can affect how a load looks or measures after delivery.
  • Material recommendations on our website and blog are general guidance. For structural, drainage, or engineered projects, follow the advice of a qualified contractor or engineer and any local codes.

7. Issues With Your Order

Please inspect your material when it is delivered. If something is wrong, such as the wrong material, a short load, or placement in the wrong spot, contact us within [number] days of delivery with your order number and clear photos of the material and drop location. Photos help us review the issue and decide on the right solution, which may include a replacement load, a partial credit, or a refund at our discretion.

Because bulk materials cannot be reloaded and resold, delivered material generally cannot be returned unless it was the wrong product or did not match your order.

8. Limitation of Liability

To the fullest extent allowed by law, Simple Gravel is not liable for indirect, incidental, special, or consequential damages, including lost profits, project delays, or the cost of labor, arising from our products, deliveries, or website. Our total liability for any claim related to an order will not exceed the amount you paid for that order.

9. Indemnification

You agree to indemnify and hold Simple Gravel, its suppliers, and delivery partners harmless from claims, damages, and costs arising from inaccurate information you provide, conditions on your property that were not disclosed to us, or your use of the materials.

10. Website Use

  • Content on this website, including text, images, logos, and design, belongs to Simple Gravel or its licensors and may not be copied or reused without permission.
  • You agree not to misuse the website, including by attempting to disrupt it, access it without authorization, or submit false orders.
  • The website may link to third-party sites. We are not responsible for their content or practices.
  • We try to keep information on the website accurate, but we do not guarantee that all content, pricing, or availability is complete, current, or error-free.

11. Privacy

Your use of the website and our services is also governed by our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [County, State], unless applicable law requires otherwise.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. The Terms in effect when you place an order apply to that order.
